Disability Grievance Procedure

Montclair State University is committed to providing students with a fair process for addressing concerns related to disability accommodations, access or possible discrimination.

Students who believe they have been denied their rights or treated unfairly based on a disability may file a grievance under Section 504 of the Rehabilitation Act and the Americans with Disabilities Act (ADA).

Filing a Grievance

Students should first direct their concern to the Director of the Disability Resource Center (DRC) by scheduling a meeting or submitting the appropriate grievance form. Grievances should be submitted within 20 days of becoming aware of the issue.

The Director will review the complaint, contact relevant parties and provide a resolution within 10 working days.

If the grievance involves the Disability Resource Center or its staff, the complaint should instead be directed to the Dean of Students.

Appeals and External Complaints

If a student is not satisfied with the resolution, they may continue the grievance process with the University’s Section 504 Compliance Officer, Yolanda Alvarez.

Students also have the right to file a complaint with the U.S. Department of Education’s Office for Civil Rights (OCR), regardless of whether they use the University’s internal grievance process.
